Terms of Use

Last updated on August 2025

Please read these Terms of Use carefully. These terms govern your access to and use of websites, services, training, materials, and related offerings provided by The Dataverse Company Inc., also known as TDC. By accessing or using TDC services, you agree to be bound by these Terms of Use and any policies referenced here.

No Warranties

Although TDC attempts to provide accurate information, documents, training materials, website content, and related resources, TDC makes no representation, endorsement, or warranty that such content is accurate, complete, current, or suitable for any particular purpose. TDC services and materials are provided on an “as is” basis, and use of them is at the user’s sole risk. Except for warranties that cannot be excluded under applicable law, TDC disclaims all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

Limitation of Liability

In no event will TDC be liable for loss of profits, loss of use, business interruption, loss of data, or any indirect, special, incidental, consequential, exemplary, or punitive damages of any kind arising out of or related to the use of TDC services, training, materials, websites, third-party websites, or any inability of TDC to provide or complete services as scheduled. This limitation applies regardless of the theory of liability and even if TDC has been advised of the possibility of such damages. TDC’s pricing reflects this allocation of risk and limitation of liability.

Use of Services and Website

TDC may provide links to websites or services operated by third parties. TDC does not control those websites or services and does not endorse or warrant their content, products, services, operators, privacy policies, or customer information practices. You are responsible for reviewing the terms and policies of any third-party websites or services you access.

Restrictions on Use

You agree not to use, or permit use of, TDC services to upload, email, post, publish, transmit, or otherwise make available material for any purpose that may: menace, harass, damage, or injure any person or property; publish false, defamatory, harassing, or obscene material; violate privacy rights or promote bigotry, racism, hatred, or harm; constitute unsolicited bulk email, junk mail, spam, or chain letters; infringe intellectual property or other proprietary rights; or otherwise violate applicable laws, ordinances, or regulations. TDC reserves the right to remove or disable access to material that violates these restrictions and will have no liability for doing so. You agree to defend and indemnify TDC against claims arising from your violation of this section.

Modifications

TDC may make modifications, changes, or alterations to its website content, services, materials, and these Terms of Use at any time. You are responsible for regularly reviewing these Terms of Use. Your continued use of TDC services after any modification, change, or alteration constitutes your acceptance of the updated terms.

Feedback

If you provide feedback, suggestions, ideas, or other input regarding TDC products or services, that feedback will be treated as non-confidential and unrestricted. TDC and its licensors retain all ownership and intellectual property rights in and to TDC products, services, and any improvements or derivatives. TDC may use feedback for any purpose, including incorporating it into products or services and displaying, marketing, sublicensing, or distributing it.

Disputes; Governing Law

Any claim relating to an alleged breach of a proposal, statement of work, or services provided by TDC must be brought no more than one year after the party bringing the claim knew or reasonably should have known about the alleged breach. Any such claim will be governed by the laws of the State of California and asserted in a federal or state court of competent jurisdiction physically located in Ventura County, California. You and TDC consent to the personal jurisdiction of those courts for this purpose.
